Is company suppose to pay me for national holidays?

I am working for a new company now, which they pay me salary per month, but I am filing W-9 tax form according them. They just told me they don't pay for holidays, including national holidays (Memorial day, July 4th ect) Is that right? or is it against the law?

A W9 form is simply a request for your Taxpayer ID Number (or Social Security Number if you are a Sole Proprietor or indiviual and not a company). Therefore, I'm assuming that your new company is paying you as an independent contractor (meaning that you are going to get a 1099 form at the end of the year instead of a W2). Most independent contractors are working under a contract and that contract should state whether holidays are paid or not. Regardless of whether you are an independent contractor or a regular employee, there is no law that states a company has to pay you for holidays. If you are physically working on that holiday, then the company is required to pay your your usual salary, but if you are not physically working, there is no law that states a company has to pay you. Many good companies will offer holiday pay (and will pay you a higher rate if you actually work on a holiday).
Reply:Reputable companies' monthly pay includes paid holidays for full time employees. Read your employment contract, if any.
